I was wrongfully arrested and falsely imprisoned on 9/29 '08. When should i start working on my civil case?

I was arrested for firearm, marijuana and paraphernalia possession In New Jersey by the Monmouth County Prosecutors Office in a house i didn't live in. Someone else admitted it was theirs. Police tried to use constructive possession as grounds for my arrest. My Lawyer Says he is trying to get my charges thrown out by grand jury. I spent 8 days in county jail and $5 000 in lawyer fees. I plan on Filing a Civil suit against the Prosecutors Office. Should I wait until the Criminal Case is over?
